1. Membership Eligibility

• You must be at least 18 years old to purchase a gym membership. Minors (ages 16–17) may use the facilities with a parent or legal guardian’s consent and supervision.

• We reserve the right to refuse or terminate membership at our discretion, including for non-compliance with these Terms or gym policies.

2. Membership Terms

• Automatic Renewal: Monthly memberships automatically renew unless canceled in writing at least 30 days before the renewal date.

• Non-Transferable: Memberships are non-transferable and may only be used by the registered member.
• Freezes and Cancellations: Members may request a membership freeze or cancellation, subject to our policies. Written notice is required, and fees may apply for early termination of fixed-term memberships.

3. Use of Facilities

• Conduct: Members must follow all gym rules, including those posted in the facility. Disruptive, unsafe, or inappropriate behavior may result in suspension or termination of membership.
• Health and Safety: You are responsible for ensuring you are physically capable of using our facilities. Consult a physician before starting any exercise program. We are not liable for injuries or health issues arising from improper use of equipment or failure to disclose health conditions.
• Equipment Use: Use gym equipment only as intended. Report any damaged equipment to staff immediately.
• Personal Belongings: We are not responsible for lost, stolen, or damaged personal items. Lockers are provided for temporary use during your visit.

4. Liability and Assumption of Risk

• Assumption of Risk: You acknowledge that physical exercise involves inherent risks, including injury or death. By using our facilities, you assume all such risks.
• Liability Waiver: To the fullest extent permitted by law, S.E. Mackey Center, its owners, employees, and affiliates are not liable for any injuries, damages, or losses incurred while using our facilities or participating in our programs, except where caused by our gross negligence or willful misconduct.
• Indemnification: You agree to indemnify and hold harmless S.E. Mackey Center from any claims, damages, or liabilities arising from your use of the facilities or violation of these Terms.
